Delhi CM Arvind Kejriwal gets bail with certain conditions from the Supreme Court.
Supreme Court grants bail to Arvind Kejriwal but split on quashing his arrest by CBI in Excise Policy case Justice Ujjal Bhuyan said CBI arrest was only a measure to make meaningless bail in ED case Added that CBI must dispel notion of being caged parrot and expressed reservations against bail condition in ED case barring Kejriwal from visiting CM Secretariat or signing files
Justice Surya Kant said “ regarding whether chargesheet filing is a material development in circumstance.. it is … but we are not relegating the appellant to the trial court. WE DIRECT ARVIND KEJRIWAL TO BE RELEASED on bail subject to bail bonds of 10 lakhs.”
Justice Surya Kant further observed that “there are 3 questions: whether there was illegality in arrest by CBI. if he can be released forthwith and whether filing of chargesheet is of such nature that he has to only go to trial court There is no impediment in arresting a person who is already in custody for another case for purposes of investigation. CBI in their application has noted why the arrest was necessary and since there was a judicial order..there was no violation of section 41(a)(3)…
Big relief for AAP; SC grants bail to CM. As per Bar and Bench tweet “Justice Ujjal Bhuyan: on the necessity and need of arrest.. arrest by CBI raises more questions than it answers ! CBI did not feel the need to arrest him though he was interrogated in march 2023 and it was only after his ED arrest was stayed.. CBI became active and sought custody of kejriwal and thus no need of arrest for over 22 months. Such action by CBI raises serious question on the timing of the arrest and SUCH A ARREST BY CBI WAS ONLY TO FRUSTRATE THE BAIL GRANTED IN ED CASE”
