To honour the Punjab and Haryana High Court order banning the bursting of crackers after 9:30 PM Police officials at Patran, Sadar Samana, City Samana, Sadar Nabha, City Rajpura registered First Information Report (FIR) unde section 188 IPC at respective Police Stations. Patran Police registered a  FIR no 242 dated 19 October 2017 against an unknown person. Samana (Sadar)  Police registered a  FIR no 188 dated 19 October 2017 against an unknown person. City Samana  Police registered a  FIR no 185 and 186 dated 19 October 2017 against an unknown person. Likewise Nabha Sadar Police registered a  FIR no 121  dated 19 October 2017 against an unknown person. Also City Rajpura Police registered a  FIR no 269 and 270  dated 19 October 2017 against an unknown person.

Punjab and Haryana high Court passed these orders to curb the pollution level. On last Friday Punjab and Haryana High Court restricted bursting of firecrackers on Diwali in Punjab, Haryana and Chandigarh to three hours I.e.  from 6:30 pm to 9:30 pm. The court also issued guidelines for granting temporary licences to firecracker sellers, after taking a suo moto cognizance of the deteriorating air quality in the region and sought information on the licences granted to traders in Punjab, Haryana and Chandigarh.

The division bench of Justice Ajay Kumar Mittal and Justice Amit Rawal directed the police to ensure adequate PCR vans are deployed for compliance of the High Court directions. The Deputy Commissioners and the Senior Superintendents of Police have also been directed to ensure the orders are followed strictly.

What is   Section 188 in The Indian Penal Code

  1. Disobedience to order duly promulgated by public servant.—Whoever, knowing that, by an order promulgated by a public servant lawfully empowered to promulgate such order, he is directed to abstain from a certain act, or to take certain order with certain property in his possession or under his management, disobeys such direction, shall, if such disobedience causes or tends to cause obstruction, annoyance or injury, or risk of obstruction, annoyance or injury, to any person lawfully employed, be punished with simple imprisonment for a term which may extend to one month or with fine which may extend to two hundred rupees, or with both; and if such disobedience causes or trends to cause danger to human life, health or safety, or causes or tends to cause a riot or affray, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.
