SIT investigating Bikram Majithia’s case malafide intent comes to the fore: Majithia’s lawyer

Today, the special investigation team (SIT) lead by DIG Patiala range Harcharn Singh Bhullar had issued summons to shiromani akali dal leader Bikram singh Majithia to join the investigation at Police Lines, Patiala against the FIR registered on December 20,2021 at Police Station Punjab State Crime, SAS Nagar under section 25,27-A, 29 of NDPS Act 1985. He is supposed to join the investigation.

But, in response to the summons, the lawyers of Bikram Majithia has sent a reply to Notice No 155/ SIT dated July 18,2024 and informed the SIT team that he is not going to join the investigation scheduled for July 20,2024 as he is in New Delhi and is assisting his lawyers in the upcoming petition before the Supreme Court listed on July 23,2024.

The lawyers have also accused the investigating team working with malafide intentions by calling their client to deter him from attending the courts and trying to prevent him from assisting and briefing his law firms , counsels and senior counsels in the upcoming petition before the Supreme Court . The apprehensions most unfortunately comes true,

In a three page letter to the SIT, the law firm “Sobti Law Office” has said that “it is the SIT that moved the Supreme Court on July 15,2024 to get the SLP (Crl.) No 3560 of 2023 (a petition for cancellation of regular bail of my client) listed on July 23,2024. At the time when reply dated July 18,2024 was submitted, the Advance Cause List of the Supreme Court had already been uploaded and the said petion was mentioned at Sr No. 204. My client is already in New Delhi to your knowledge for the purpose of effectively assisting and briefing his lawyers.”

“ My client is under surveillance which is illegal and unlawful. The SIT deliberately chose to misuse its powers in order to prevent my client from seeking remedies available under law to him. It is pertinent to mention here that on all previous occasions my client has appeared before all four SITs and when called and subjected himself to investigation for hours on the same stale and irrelevant material. My client has utmost respect for the process of law “ said his lawyer.

“ However, this conduct of the SIT, brazenly attempting to scuttle my client’s right to have access to law which slows that there can be no free and fair investigation by the present SIT. The intentions to issue these notices to my client, specifically choosing dates on which it is impossible for my client to come present, is only to set-up a false plea of non-cooperation. The Chairman if the SIT is on record in the press stating that non-cooperation on behalf of my client shall be pleaded. This plea being false, against record shall be vehemently challenged” said Damanbir Singh Sobti, Advocate of Bikram Singh Majithia.
